By accessing or using mkassistant.ai (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We may update these terms from time to time, and continued use after changes are posted constitutes acceptance of the revised terms.

2. Description of Service

mkassistant is a technology platform that provides AI-powered chart analysis, trading behavior review, Pine Script generation and evolution, AI coaching, and self-improvement workflows for traders. The Service is an analytical and educational tool. It is not a financial advisory service, brokerage, or investment platform, and does not provide trading signals, investment advice, or guaranteed outcomes.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are solely responsible for all activity that occurs under your account, including activity driven by AI-generated outputs that you choose to use. You must notify us immediately at support@mkassistant.com if you become aware of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Share, resell, or redistribute your account access or any output generated by the Service
• Abuse the AI systems by submitting intentionally misleading, harmful, or fraudulent data
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools or bots to access the Service beyond normal usage patterns
• Circumvent any usage limits, rate limits, or access restrictions

5. Intellectual Property

You retain full ownership of your trading strategies, chart data, uploaded images, journal entries, and any Pine Script code you create or provide to the Service. By using the Service, you grant mkassistant a limited, non-exclusive license to process your content solely for the purpose of delivering the Service to you.

The mkassistant platform, its design, branding, AI models, proprietary workflows, and all underlying technology are owned by mkassistant and protected by intellectual property laws. You may not copy, modify, or create derivative works of any part of the platform without written permission.

6. Subscription and Billing

Paid features are available through subscription plans. Billing terms, cancellation, and refund policies are governed by our Refund and Cancellation Policy. By subscribing, you authorize recurring charges to your payment method until you cancel.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice when possible.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. mkassistant does not warrant that AI-generated analysis, Pine Scripts, or behavioral reviews will be accurate, complete, or suitable for any specific trading purpose. All trading decisions are made at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, mkassistant and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, data loss, or other intangible losses arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to mkassistant in the twelve months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or abuse the platform. You may terminate your account at any time by canceling your subscription and contacting support@mkassistant.com. Upon termination, your right to access the Service ceases immediately, though we may retain certain data as required by law or as outlined in our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which mkassistant operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
